1. Do you have a stated compensation policy? A good policy spells out a broad framework within which decisions about starting pay, raises, variable compensation and related issues are made. Consider your policy a strategic planning document. If you find yourself making compensation decisions on an ad hoc basis every year, you probably need a sound policy.

2. How well do you explain benefits to employees? Do they understand that benefits comprise a significant portion of their total compensation?

Sure, you should spell out the value of your benefits in your handbook. But you should also hold regular face-to-face meetings to explain what they?re worth. More important, you should make sure employees understand that benefits only have value when they are used.

3. Do employees have access to re??li??able information about pay practices? If the office grapevine is where most em??ployees learn how compensation works, you need to fix that. Fewer topics cause greater dissension than uninformed spec?u?lation about how much co-workers earn or how big their raises were.

Take control of the rumor mill by offering concrete information about how you (and your supervisors) make pay decisions. Share the formulas you use to calculate merit increases and set variable compensation levels.

4. How much does pay depend on performance? Do employees understand what they have to do to earn a fatter paycheck? Do your merit-increase and variable-pay criteria make sense from an employee?s perspective?

Is it within employees? control to achieve goals that pay off? Or are the performance measures largely based on market forces or management decisions that employees can never influence?

Here?s where you need to work hard to align leadership priorities, management attitudes and employee expectations. Transparency will help. That doesn?t mean posting everyone?s rate of pay on the company bulletin board. It does mean making sure everyone believes that compensation is based on a rational system that rewards effort and other measurable contributions to the organization?s success.

5. How much do variable pay plans really pay out? No surprise: Em??ployees tend to like plans that actually reward better pay for better performance. If your variable-pay program promises bonuses every year, but no one ever seems to get a bonus, you probably have a credibility problem.

Note: It?s impossible to address variable pay and pay for performance without carefully considering how your performance-appraisal system works in real life. If employees and supervisors don?t take your performance-management system seriously, good luck stamping out cynicism about merit raises and variable compensation.

6. To what extent do compensation and benefits programs reflect your organization?s values? If you say you?re a customer-driven company, your compensation systems had better reward excellent customer service. If research and development is your organization?s competitive advantage, it?s reasonable to establish bonus criteria that reward creativity and initiative.

Do your recruitment materials tout a corporate culture that honors work/life balance? Make sure your benefits support that?through offerings such as wellness programs, flex schedules, leave policies and other programs that acknowledge that employees don?t just live to work.

7. How would employee dissatisfaction with pay and benefits affect your organization? The morale hit could result in poor employee ?performance. It could create a revolving door, launching an exodus of your best employees.

Plus, if word of dodgy pay and benefits practices leaks out, you might find it harder to attract the new workers you need.

Belgian man arrested in LA for alleged stalking (omg!)

LOS ANGELES (AP) ? Authorities say an alleged stalker traveled from Belgium to Los Angeles in the hopes of getting close to comedian Esther Povitsky, who has appeared on Jimmy Kimmel's late night television show.

Sheriff's officials said Tuesday that Pierre Van Lint was arrested at a Hollywood hotel after showing up at a comedy theater where Povitsky performs.

The comedian told investigators she had been receiving unsolicited emails from Van Lint for eight months, some of which she described as aggressive and inappropriate. The number of emails increased in the 48 hours prior to his arrest.

Van Lint was booked on stalking charges and held on $50,000 bail.

The 23-year-old Povitsky performs in Los Angeles and has also appeared on the Fox sitcom "New Girl."

HTC to launch "Dragon" series smartphone in mainland China, expand to international markets in the future

HTC may have just announced its highfalutin One family of smartphones in Barcelona, but it's still the year of the Dragon back home -- and the Taiwanese outfit has the slabs to prove it. Meet the "Dragon" series, a trio of 4-inch Android handsets, each sporting a 5 megapixel camera, a 1GHz single-core processor and Beats Audio, all wrapped up in an Ice Cream Sandwich slathered in Sense 4.0A. Although the Dragon series seems a bit like the HTC One V -- albeit with a larger screen -- the outfit says it won't be packing the HTC ImageChip that hopes to give the One series' cameras a wicked performance boost. Sadly, the "Dragon" moniker is a temporary handle, and the three phones are only coming to mainland China. HTC says there are plans to expand the family in the future for international distribution, but for now the handsets are only coming to China Telecom, China Unicom and China Mobile.

YEARS ago, Charlie, a highly respected orthopaedist and a mentor of mine, found a lump in his stomach. He had a surgeon explore the area, and the diagnosis was pancreatic cancer. This surgeon was one of the best in the country. He had even invented a new procedure for this exact cancer that could treble a patient's five-year-survival odds - from 5 per cent to 15 per cent - albeit with a poor quality of life.

Charlie was uninterested. He went home the next day, closed his practice, and never set foot in a hospital again. He focused on spending time with family and feeling as good as possible. Several months later, he died at home. He got no chemotherapy, radiation, or surgical treatment. Medicare didn't spend much on him.

It isn't a frequent topic of discussion, but doctors die, too. And they do not die like the rest of us. What is unusual about them is not how much treatment they get compared with most Americans, but how little. For all the time they spend fending off the deaths of others, they tend to be fairly serene when faced with death themselves. They know exactly what is going to happen, they know the choices, and they generally have access to any sort of medical care they could want. But they go gently.

Of course, doctors don't want to die; they want to live. But they know enough about modern medicine to know its limits. And they know enough about death to know what all people fear most: dying in pain, and dying alone. They have talked about this with their families. They want to be sure, when the time comes, that no heroic measures will happen - that they will never experience, during their last moments on earth, someone breaking their ribs in an attempt to resuscitate them with cardiopulmonary resuscitation (that's what happens if CPR is done right).

Almost all medical professionals have seen what we call 'futile care' being performed on people. That is when doctors bring the cutting edge of technology to bear on a grievously ill person near the end of life. The patient will get cut open, perforated with tubes, hooked up to machines, and assaulted with drugs. All of this occurs in the Intensive Care Unit (ICU) at a cost of tens of thousands of dollars a day. What it buys is misery we would not inflict on a terrorist. I cannot count the number of times fellow physicians have told me, in words that vary only slightly: 'Promise me, if you find me like this, that you'll kill me.' They mean it. Some medical personnel wear medallions stamped 'NO CODE' to tell physicians not to perform CPR on them. I have even seen it as a tattoo.

To administer medical care that makes people suffer is anguishing. Physicians are trained to gather information without revealing any of their own feelings, but in private, among fellow doctors, they'll vent. 'How can anyone do that to their family members?' they'll ask. I suspect it is one reason physicians have higher rates of alcohol abuse and depression than professionals in most other fields. I know it is one reason I stopped participating in hospital care for the last 10 years of my practice.

How has it come to this - that doctors administer so much care that they wouldn't want for themselves? The simple, or not-so-simple, answer is this: patients, doctors, and the system.

To see how patients play a role, imagine a scenario in which someone has lost consciousness and been admitted to an emergency room. As is so often the case, no one has made a plan for this situation, and shocked and scared family members find themselves caught up in a maze of choices. They are overwhelmed. When doctors ask if they want 'everything' done, they answer yes. Then the nightmare begins. Sometimes, a family really means 'do everything', but often they just mean 'do everything that's reasonable'. The problem is that they may not know what is reasonable, nor, in their confusion and sorrow, will they ask about it or hear what a physician may be telling them. For their part, doctors told to do 'everything' will do it, whether it is reasonable or not.

The above scenario is a common one. Feeding into the problem are unrealistic expectations of what doctors can accomplish. Many people think of CPR as a reliable life-saver when, in fact, the results are usually poor. I have had hundreds of people brought to me in the emergency room after getting CPR. Exactly one, a healthy man who'd had no heart troubles (for those who want specifics, he had a 'tension pneumothorax'), walked out of the hospital. If a patient suffers from severe illness, old age, or a terminal disease, the odds of a good outcome from CPR are infinitesimal, while the odds of suffering are overwhelming. Poor knowledge and misguided expectations lead to a lot of bad decisions.

But of course it's not just patients making these things happen. Doctors play an enabling role, too. The trouble is that even doctors who hate to administer futile care must find a way to address the wishes of patients and families. Imagine, once again, the emergency room with those grieving, possibly hysterical, family members. They do not know the doctor. Establishing trust and confidence under such circumstances is a very delicate thing. People are prepared to think the doctor is acting out of base motives, trying to save time, or money, or effort, especially if the doctor is advising against further treatment.

Some doctors are stronger communicators than others, and some doctors are more adamant, but the pressures they all face are similar. When I faced circumstances involving end-of-life choices, I adopted the approach of laying out only the options that I thought were reasonable (as I would in any situation) as early in the process as possible. When patients or families brought up unreasonable choices, I would discuss the issue in layman's terms that portrayed the downsides clearly. If patients or families still insisted on treatments I considered pointless or harmful, I would offer to transfer their care to another doctor or hospital.

Should I have been more forceful at times? I know that some of those transfers still haunt me. One of the patients of whom I was most fond was an attorney from a famous political family. She had severe diabetes and terrible circulation, and, at one point, she developed a painful sore on her foot. Knowing the hazards of hospitals, I did everything I could to keep her from resorting to surgery. Still, she sought out outside experts with whom I had no relationship. Not knowing as much about her as I did, they decided to perform bypass surgery on her chronically clogged blood vessels in both legs. This did not restore her circulation, and the surgical wounds would not heal. Her feet became gangrenous, and she endured bilateral leg amputations. Two weeks later, in the famous medical centre in which all this had occurred, she died.

It is easy to find fault with both doctors and patients in such stories, but in many ways all the parties are simply victims of a larger system that encourages excessive treatment. In some unfortunate cases, doctors use the fee-for-service model to do everything they can, no matter how pointless, to make money. More commonly, though, doctors are fearful of litigation and do whatever they are asked, with little feedback, to avoid getting in trouble.

Even when the right preparations have been made, the system can still swallow people up. One of my patients was a man named Jack, a 78-year-old who had been ill for years and undergone about 15 major surgical procedures. He explained to me that he never, under any circumstances, wanted to be placed on life support machines again. One Saturday, however, Jack suffered a massive stroke and got admitted to the emergency room unconscious, without his wife. Doctors did everything possible to resuscitate him and put him on life support in the ICU. This was Jack's worst nightmare. When I arrived at the hospital and took over Jack's care, I spoke to his wife and to hospital staff, bringing in my office notes with his care preferences. Then I turned off the life support machines and sat with him. He died two hours later.

Even with all his wishes documented, Jack had not died as he had hoped. The system had intervened. One of the nurses, I later found out, even reported my unplugging of Jack to the authorities as a possible homicide. Nothing came of it, of course: Jack's wishes had been spelt out explicitly, and he'd left the paperwork to prove it. But the prospect of a police investigation is terrifying for any physician. I could far more easily have left Jack on life support against his stated wishes, prolonging his life, and his suffering, a few more weeks. I would even have made a little more money, and Medicare would have ended up with an additional US$500,000 (S$629,000) bill. It is no wonder many doctors err on the side of overtreatment.

But doctors still don't over-treat themselves. They see the consequences of this constantly. Almost anyone can find a way to die in peace at home, and pain can be managed better than ever. Hospice care, which focuses on providing terminally ill patients with comfort and dignity rather than on futile cures, provides most people with much better final days. Amazingly, studies have found that people placed in hospice care often live longer than people with the same disease who are seeking active cures. I was struck to hear on the radio recently that the famous reporter Tom Wicker had 'died peacefully at home, surrounded by his family'. Such stories are, thankfully, increasingly common.

Several years ago, my older cousin Torch (born at home by the light of a flashlight) had a seizure that turned out to be the result of lung cancer that had gone to his brain. I arranged for him to see various specialists, and we learnt that with aggressive treatment of his condition, including three to five hospital visits a week for chemotherapy, he would live perhaps four months. Ultimately, he decided against any treatment and simply took pills for brain swelling. He moved in with me.

We spent the next eight months doing a bunch of things that he enjoyed, having fun together like we hadn't had in decades. We went to Disneyland, his first time. We hung out at home. Torch was a sports nut, and he was very happy to watch sports and eat my cooking. He even gained a bit of weight, eating his favourite foods rather than hospital foods. He had no serious pain, and he remained high-spirited. One day, he didn't wake up. He spent the next three days in a coma-like sleep and then died. The cost of his medical care for those eight months, for the one drug he was taking, was about US$20.

Torch was no doctor, but he knew he wanted a life of quality, not just quantity. Don't most of us? If there is a state of the art of end-of-life care, it is this: death with dignity. As for me, my physician has my choices. They were easy to make, as they are for most physicians. There will be no heroics, and I will go gentle into that good night. Like my mentor Charlie. Like my cousin Torch. Like my fellow doctors.

The BenQ Joybee GP2 ($599 direct) palmtop projector is the follow-up to the BenQ Joybee GP1, an Editors? Choice from 2009. As a palmtop projector, the GP2 is a bit on the large side, at 2.2 by 5.5 by 5.1 inches (HWD), though it did fit into my outstretched palm with fingers fully splayed. I weighted it on a postage scale at 1.2 pounds; 2.0 pounds when I included the power adaptor and power cord. An optional battery is expected to be available soon.

The projector has a black top and white sides, which curve outward toward the top. Three sides have speaker or ventilation grilles. One side has most of the ports; the side next to the lens holds the focus ring; and the back has an SD card slot. There?s no lens cover, so you?ll want to keep the projector in its soft carrying case when not in use.?

Image Quality

The Joybee GP2 displayed an image that filled our test screen (about 66 inches diagonal) from about 5 feet away. (As is typical of palmtops, the projector has a focus wheel but lacks a zoom control.)? Data images were bright enough to be usable in a darkened room, although a couple of images showing colored lines on a black background were marginal, as the lines did not display well. When I added a modest amount of ambient light to the room, the images looked washed out.

I ran the GP2 through our standard suite of DisplayMate tests. Color generally was good, with occasional, mild yellow or greenish tints in images. To its credit, the projector shows very little of the rainbow effect that often plagues DLP projectors, in which bright areas break up into little red-green-blue rainbows when you shift your gaze or an object moves on screen.

The projector did have one notable issue. According to BenQ, the GP2?s native resolution is WXGA (1,280 by 800 pixels). However, in several data images, I saw a pattern of spurious, faint lines or bands, reminiscent of a scaling artifact in which there?s a mismatch between the image source?s and the projector?s (specifically, its DLP chip?s) resolution. ?

We?ve seen similar issues in other WXGA DLP mini-projectors lately, and the chip maker, Texas Instruments, has yet to explain the nature of the artifacts. I?m not certain if the GP2?s issue is identical (BenQ couldn?t specify the exact model chip), but the lines?which appear mostly in images with finely patterned or hatched backgrounds?are distracting. In presentations, as opposed to our test images, they?d be most likely to affect readability of smaller type. The two smallest fonts in the GP2?s type test were blurred, which is worse than usual for the WXGA projectors I?ve tested.

I viewed video on the GP2 from two sources: a DVD player over an HDMI cable, and my iPhone. Although you could use it to view movies with, it wouldn?t be my preferred method, as it lost detail in both bright and dark areas, and flesh tones sometimes took on a reddish hue. At least you?ll have decent audio at a volume that should fill a small room, from the twin 2-watt speakers.

There?s a lot to like about the BenQ Joybee GP2. Its small size and portability make it useful for anything from making business presentations to small groups to showing photos, videos, or playing music at a party. Its built-in dock lets you play content from an iPhone or iPod touch. It offers connectivity via HDMI, VGA, composite video, or USB cable. The menu system is user friendly.

The GP2?s downside is that its image quality, for both data and video, was less than optimal. The Acer K11 offers better data image quality, while the larger Epson MegaPlex MG-850HD incorporates an i-Thing dock and has great data and video image quality. But the JoyBee GP2 is versatile, highly portable, and a lot of fun?well worth considering, particularly if you want to go small.

Under CERCLA, Responsible Parties Liable for Future Clean-Up ...

In State v. Solvent Chemical Co., 10-2026-cv (2nd Cir. Dec. 19, 2011), the Second Circuit Court of Appeals held that Solvent Chemical Company (?Solvent?) could obtain a declaratory judgment that two adjacent property owners were responsible for future costs incurred by Solvent under the Comprehensive Environmental Response, Compensation, and Liability Act (?CERCLA?), 42 U.S.C. ?? 9601-9675.

Over the past century, Solvent, E.I. du Pont de Nemours & Co. (?DuPont?) and Olin Corporation (?Olin?), owned adjacent properties in Niagara Falls, New York at which various hazardous substances were manufactured.? In 1983, the State of New York sued Solvent and others for environmental contamination at the Solvent Site. In 1996, the New York Department of Environmental Conservation (?DEC?) issued a Record of Decision (?ROD?) requiring Solvent to undertake remedial action to cleanup the contamination on the property.? Solvent subsequently entered into a consent decree obligating it to perform the remedies specified in the ROD in settlement of New York?s CERCLA claims. Solvent?s cleanup operations began in 1999 and are ongoing.

Solvent sued both Olin and DuPont under CERCLA seeking, in part, contribution for its response costs incurred under its consent decree with New York on the basis of the hazardous substances originating from their respective facilities. Solvent?s claims against DuPont and Olin were consolidated in a trial that lasted 19 days in late 2007. The parties stipulated that all response costs incurred through June 30, 2007 would be treated as ?past costs,? and that all costs thereafter would be the subject of Solvent?s corresponding suit for a declaratory judgment that DuPont and Olin were liable for future cleanup costs.

The District Court for the Western District of New York awarded Solvent contribution for past costs, but declined to issue a declaratory judgment on the issue of future costs; the district court declined to declare liability mainly because the allocation of future costs would be premature. Solvent appealed the District Court?s denial of a declaratory judgment of liability for future cleanup costs under CERCLA.? The Second Circuit Court of Appeals reversed.

In reversing the lower court, the Second Circuit relied not on CERCLA, but on the federal Declaratory Judgment Act, 28 U.S.C. ? 2201(a), which lists five factors that a court must consider when determining whether a declaratory judgment may be issued:

  1. Whether the judgment will serve a useful purpose in clarifying or settling the legal?issues?involved;
  2. Whether a judgment would finalize the controversy and offer relief from uncertainty;
  3. Whether the proposed remedy is being used merely for procedural fencing or a race to res judicata;?
  4. Whether the use of a declaratory judgment would increase friction between sovereign legal systems or improperly encroach on the domain of a state or foreign court; and?
  5. Whether there is a better or more effective remedy.

In this case, the Second Circuit held that the factors considered by the district court ? but determined by it to be insufficient ? were, in fact, sufficient to require a declaratory judgment in favor of Solvent.

In reviewing these factors under the Declaratory Judgment Act, the Court concluded:

the judgment would ?serve a useful purpose in . . . settling the legal issues involved,? the judgment is not being used for procedural gamesmanship or a race to res judicata, it will not increase friction between sovereign legal systems, and there is no ?better or more effective remedy? ? in fact there would be no remedy for Solvent at all without declaratory relief.? It does not matter that a declaratory judgment of liability alone will not ?finalize the controversy and offer relief from [all] uncertainty.? (internal citations omitted)

The Second Circuit stated that:

[t]he reasons given by the district court might justify a refusal to allocate cleanup responsibility; none of them, however, supports a refusal to grant a declaratory judgment as to liability itself. The district court has already decided that Olin and DuPont were liable for contribution as to historical losses. Save for the possibility that the DEC might in the future impose different remedies to clean up the [contaminants], none of the factors identified by the court distinguishes between past and future cleanup. (emphases in original)

Conclusion

A declaratory judgment is used by parties to declare the rights, duties, or obligations of one or more of those parties in a dispute. When a court issues a declaratory judgment, it is not necessarily the end of the litigation, but it is particularly useful in saving the parties (and the courts) substantial time and money.

Here, when the Second Circuit held that DuPont and Olin were responsible under CERCLA for the contamination on the property ? and therefore also contribution to the remediation costs ? it only left one (smaller) issue to be determined in the future, namely what amount of the contribution for future clean up costs would DuPont and Olin would be responsible.? Thus, the parties never again have to litigate these facts as to whether? DuPont and Olin are potentially responsible parties under CERCLA (or worry about the short 3-year statute of limitations for contribution claim under CERCLA); Solvent merely needs to seek ?further relief? to establish the precise costs that each party will be required to pay.

This case is a perfect example of when potentially responsible parties under CERCLA can and should use a declaratory judgment action to break through the mire which can be CERCLA litigation (e.g., complex claims and defenses, weeks of trial, thousands of pages of documents and briefing, years of litigation, etc.), namely, when the potentially responsible parties are known and have already been allocated responsibility for past costs, even though there are still future costs that will need to be apportioned.

The Voice Judges: Returning For Season 3 ... This Fall!


All four judges on NBC's hit singing competition series The Voice will return to the NBC hit for a third season that will air in the fall instead of the winter.

Christina Aguilera previously agreed to return for $10 million next season. Now, Cee-Lo Green, Adam Levine and Blake Shelton are back on board too.

All with substantial pay raises, according to those close to the negotiations. Green, Levine and Shelton will see their pay roughly doubled to $6 million.

Insiders say Levine had been holding out because of a scheduling issue. He and his band, Maroon 5, have an album nearing completion, and tour dates and promotion of the new record had to move to accommodate the show's move to the fall.

It looks like that worked out, though, and not a moment too soon for NBC.

It averages an 8.4 rating/21 share in the crucial 18-49 demographic and 21.3 million viewers overall. It owes that average largely to huge ratings for the Season 2 premiere, debuting after the Super Bowl, but nevertheless, it's a success.

Moving to the fall would have the show, now a mid-season hit, airing at the same time of year as Fox's The X-Factor ... and being a lot more entertaining.
